This page explains the EU right of withdrawal for distance contracts and how LotusFarma intends to handle it when paid distance selling becomes available.

Today, this website only accepts non-binding offline order requests. No distance sale is concluded through the website itself and no online payment is taken.

Current status of this site

Submitting an order request through LotusFarma is a reservation request only. The pharmacy confirms availability, price, legal conditions and next steps personally.

Because no paid distance sale is concluded through this website today, the statutory withdrawal process normally starts only if and when a distance contract is actually concluded later.

14-day withdrawal right

For qualifying EU distance contracts, consumers generally have 14 days to withdraw without giving a reason. For goods, the period usually runs from the day the consumer or a nominated third party receives the goods. For services, it usually runs from contract conclusion.

When LotusFarma opens paid distance selling, the pharmacy will provide the required pre-contract information, confirmation and withdrawal instructions before or at the time of sale.

How to withdraw

If a qualifying distance contract exists, you can withdraw by sending a clear statement by email or post before the 14-day period expires. You may use the model form below, but it is not mandatory.

Effects of withdrawal

Where the right applies and is exercised on time, payments received for the withdrawn distance contract are reimbursed according to the legal rules and any return instructions provided at sale.

Consumers may have to return goods without undue delay and may be responsible for diminished value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Possible legal exceptions

Belgian and EU consumer law contains exceptions to the withdrawal right. Depending on the product and circumstances, exceptions can include sealed goods that are not suitable for return for health or hygiene reasons once unsealed, perishable goods, custom-made goods and services fully performed with prior consent where the law allows it.

The pharmacy will identify any applicable exception before a paid distance sale is concluded.
